Agreement
These Terms of Service (“Terms”) govern your access to and use of CrowsStack services. By using our services, you agree to these Terms.
Accounts and Responsibilities
- You are responsible for your account, credentials, and safeguarding access tokens and API keys.
- You must ensure your use complies with applicable laws and the policies of any integrated providers (e.g., WhatsApp Cloud API, email, or other messaging APIs).
- You must maintain accurate contact, billing, and compliance information.
Acceptable Use
- No illegal, harmful, abusive, or infringing activity.
- No unauthorized access, probing, or interference with our systems or third-party services.
- No spam or unsolicited communications; you must have a lawful basis and valid consent for any messaging.
- No transmission of malware or content that violates privacy, intellectual property, or applicable regulations.
Messaging via WhatsApp Cloud API and Other Providers
- Consent: You must obtain, record, and maintain end-user consent for messaging, including applicable WhatsApp Business Policies requirements. You must promptly honor opt-out requests.
- Content and Templates: When templates are required by a provider (e.g., WhatsApp), you are responsible for ensuring template approval and compliance with all provider rules.
- Rate Limits and Quality: You must adhere to provider rate limits and quality thresholds; we may throttle or suspend traffic to protect service quality and comply with provider policies.
- Data Handling: You are responsible for lawful collection and processing of end-user data. We process message content and metadata only to deliver the service, provide support, and comply with law.
Service Levels and Modifications
We continually improve and may modify features or APIs. We strive for high availability but do not guarantee uninterrupted service. Maintenance or provider incidents may affect messaging and delivery.
Fees and Billing
Fees, taxes, and billing cycles are specified at purchase time or in your account. You are responsible for charges from third-party messaging providers (e.g., per-message fees) unless otherwise agreed.
Privacy
Our processing of personal data is described in the CrowsStack Privacy Policy. By using our services, you acknowledge and agree to that policy.
Suspension and Termination
- We may suspend or terminate access for violations of these Terms, legal requirements, or provider policies, or to protect the integrity and security of the service.
- Either party may terminate at any time as specified in your order or account settings; accrued fees remain payable.
Warranties and Disclaimers
Services are provided “as is” and “as available” without warranties of any kind, express or implied. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the maximum extent permitted by law.
Limitation of Liability
To the fullest extent permitted by law, CrowsStack and its suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our aggregate liability under these Terms will not exceed the amount paid for the services in the 12 months preceding the claim.
Indemnification
You agree to indemnify and hold CrowsStack harmless from claims arising out of or related to your use of the services, your content, or your violation of these Terms or applicable laws and provider policies.
Governing Law
These Terms are governed by the laws of the jurisdiction specified in your order or account, without regard to conflict of laws principles. Venue shall lie in the competent courts of that jurisdiction.
